ELIGIBILITY. Entry purchaser, and anyone to whom an entry purchaser legally transfers an entry, must be either a business entity or an individual 21 years or older at time of entry purchase. Individuals buying on behalf of a business entity must be legal representatives of the business and must, themselves, be 21 years or older at time of entry purchase. Initial entry purchaser must be present in the state of Arizona at the time of entry purchase. It is not necessary to be a resident of the state of Arizona, but one must be physically present in Arizona at the time of entry purchase. Only one (1) individual may be identified as an entry purchaser. All federal, state and local laws and regulations apply. The Health & Wealth Raffle (the "Raffle") is conducted in English (with Spanish speaking representatives available at the call center). Entries may be purchased via the internet, call center or at designated drop-off center(s). Entry purchasers providing the Raffle with a valid email address will receive confirmation number(s) by return email. This is the only confirmation that will be provided. For all other entry purchasers, ticket confirmation number(s) will be sent within ten (10) business days of purchase. A hard copy ticket confirmation number is not required to claim a prize. Questions concerning ticket confirmation number(s) should be directed to the "Administrator," CBIZ MHM, LLC, at the address listed below. By entering the Raffle, the entry purchaser acknowledges that he or she is aware of, and agrees to abide by, the Raffle's rules and regulations.
The following individuals and their respective affiliates, subsidiaries, parent and related companies and agencies are not eligible to participate in the Raffle: (a) Board members and executive management staff of St. Joseph's Hospital and Medical Center; (b) Board members and executive management staff of St. Joseph's Foundation and Barrow Neurological Foundation; and (c) the employees of CBIZ, Inc. and its subsidiaries. The above list of exclusions (items a, b, c) also applies to immediate family members residing in the same household.
DRAWINGS. Only 98,000 tickets will be sold at two price points with limited quantities of each: single tickets for $100 and 3-packs for $250. Entries received after the requested ticket package is sold out will be returned to the requesting entrant. Draw dates are: Early Bird Draw – September 10, 2009, for which entries will be accepted until midnight September 2, 2009; Final Draw – October 8, 2009, for which entries will be accepted until midnight September 30, 2009. Prizes with the lowest manufacturers suggested retail price will be drawn first progressing in order to the Grand Prize.
The Early Bird Draw is for two (2) prizes which will be awarded to the first two (2) numbers drawn on the Early Bird Draw date. Should all entries be sold out by midnight September 2, 2009, all draws for the remaining 5,608 prizes will also be made on the Early Bird Draw date. After each draw, the winner's entry number will be returned for all subsequent draws. Each entry remains in the draw for all prize drawings. If entries are not sold out by midnight September 2, 2009, entry purchasers who purchased before or after midnight September 2, 2009, are eligible for all of the remaining 5,608 prizes on the Final Draw date of October 8, 2009. In the event entry sellout occurs after midnight September 2, 2009, but before midnight September 30, 2009, the Final Draw will be held ten (10) calendar days after entry sellout or on the scheduled draw date, whichever comes first. If the tenth day falls on a weekend or legal holiday, the draw will be the next business day. Entry purchasers may win more than one prize. Requests for ticket cancellations and ticket reassignments must be made by noon, September 7, 2009, prior to the Early Bird Draw or noon, three (3) business days prior to the Final Draw date. All entries are non-refundable after the noon deadline or once an entry has been included in any draw. In the Raffle, there is no possibility of a tie. All draws will be under the supervision of the Administrator. All time references to noon and midnight are Mountain Standard Time.
PRIZES. 5,610 prizes will be awarded. Prizes may not be exactly as shown in the brochure or on the web site and are based on manufacturer's availability. If unavailable, similar or like kind prizes may be substituted at the sole discretion of the Administrator. The approximate retail value of all combined prizes is more than $4,390,000.00 MSRP (manufacturer's suggested retail price), based on pricing at the time of prize selection. All MSRPs are rounded to the nearest dollar. No prize is valued at less than $100.00 MSRP. Only specified prizes may be exchanged for cash value. With proper transfer or sales documents bearing notarized signatures, as required by the Raffle, a prize may be transferred, sold, or donated back to St. Joseph's Hospital and Medical Center, St. Joseph's Foundation and/or Barrow Neurological Foundation.
NOTIFICATION OF WINNERS. All winners will be notified via courier, mail, or by email where available, by the Administrator of the requisite procedure to claim the prize. Prizes, excluding vehicles, will be sent to the winner's home address unless otherwise agreed upon by the Administrator and the winner.
All Grand Prize winners must claim their prize within fourteen (14) calendar days. Winners of vehicles are required to claim their prize within twenty-one (21) calendar days (with the exception of custom vehicles, details for which will be provided in winner notification), and vacation packages are required to claim their prize within forty-five (45) calendar days. All remaining prizes are to be claimed by winners within six (6) months unless otherwise stipulated in the prize letter. Three (3) business days after the completion of the Final Draw, entry purchasers can access www.healthwealthraffle.org to check prize winning status using their ticket confirmation number. Also at that time, a complete prize winners list with winners' names and locations by city or town, and state, will be available on the website. A printed version of the prize winners list will be available within 30 days of the Final Draw by contacting the Administrator (contact information below).
If a selected winner is unable to be contacted or located after a period of six (6) months from the Draw date, the prize or a cash equivalent will revert to St. Joseph's Hospital and Medical Center to support research and graduate medical education. Three (3) attempts will be made to deliver the prize to the address provided by the winner.
In the event a winning entry has more than one name listed on the ticket, The Administrator, CBIZ MHM, LLC, will physically award the prize to the first name listed on the entry. For tax purposes,
the prize can be split among all ticket purchasers. However, tickets may only be issued to people, with corporations and other legal entities being ineligible to enter or win. Neither CBIZ MHM,
LLC, the Health & Wealth Raffle Executive Director, St. Joseph's Hospital and Medical Center, St. Joseph's Foundation and Barrow Neurological Foundation nor their legal counsel are responsible
for resolving disputes which may arise from any conflict between or amongst joint ticket holders or purchasers.
Purchase of an entry in the Raffle, constitutes permission for the Raffle and St. Joseph's Hospital and Medical Center to use winner's name, address and/or likeness, in perpetuity, for purposes
of advertising the Raffle or future raffles without further consent or compensation, unless prohibited by law.
REQUIREMENTS. The winner may be required to execute and return an Affidavit of Eligibility, a Liability Release and a Publicity Release (the "Affidavit/Release"). The Affidavit/Release must be returned by the deadline stated in such documents. If the potential winner fails to return such documents within that time, or if an entrant is found to be ineligible, or if a potential winner does not comply with the Official Rules, then the potential winner will be disqualified and the prize or a cash equivalent will revert to St. Joseph's Hospital and Medical Center and/or Barrow Neruological Foundation.
WAIVER / LIMITATIONS OF LIABILITY. Entry purchasers, by participating (and winners, by accepting a prize) release Catholic Healthcare West d/b/a St. Joseph's Hospital and Medical Center, St. Joseph's Foundation and Barrow Neurological Foundation, and their respective parent companies, affiliates, partners, subsidiaries, agents, representatives, sponsors, service agencies and independent contractors, and each of their respective directors, officers, partners, employees and agents, including advertising and promotion agencies, from any and all liability with respect to participation in the promotion, possession, use and distribution of the prize(s) awarded.
INTERNET. The Raffle will pursue all available legal remedies against any individual(s) damaging or attempting to damage any Health & Wealth Raffle website or attempting to undermine the lawful operation of the Raffle.

TAXES AND IRS RULES. All winners shall be responsible for any and all federal, state and local income or excise taxes, fees, assessments and like charges associated with the prizes. All vehicle winners shall be responsible for any and all state or local license, title, registration, documentation and prep fees associated with the vehicles. All cash prizes will be paid net of applicable income tax withholding.
SPECIAL NOTE: At the time of this printing, federal law requires that corresponding tax withholding on prize values of $5,000 or greater must be collected from winners upon award and distribution. Federal and state withholding laws are subject to change without notice. The withholding laws in effect at the time prizes are claimed will be followed. The IRS has taken the position that amounts paid for chances to participate in raffles, lotteries or similar programs are not gifts and, therefore, the price of the entry does not qualify as a deductible charitable contribution.
